Earlier this month the City of Platte City filed its answer and counterclaim to Rose-Lan Contractors’ breach of contract lawsuit against the city regarding the north trunk interceptor line sewer project. In the lawsuit, Rose-Lan claims that the city misrepresented key soil conditions that would have influenced their bid, then failed to approve change order requests or to pay the company’s invoices which totaled more than $763,000. Thus immobilized by lack of operating capital, Rose-Lan claims it was put out of business by the city’s actions. Rose-Lan seeks relief from the court of $763,469 in unpaid invoices billed to the city, and also for the value of its lost business as well as interest and attorney fees.
