HELD ON $50,000 CASH-ONLY BOND
A driver who struck and killed a bicyclist near Riverside was under the influence at the time, authorities say.
Emily A. Davis, 25, of Kansas City in Platte County, faces a felony charge of DWI–death of another. She is being held in the Platte County Jail on a bond of $50,000 cash only.
Her next court appearance is scheduled for Oct. 1.
As reported in last week’s edition of The Landmark, the crash occurred at 5:30 a.m. Monday, Sept. 16 on NW Tullison, which is an outer road near Hwy. 9. according to a report by the Missouri State Highway Patrol, killed was Xavier M. Anderson, age 25, of Kansas City. Troopers say the rear of Anderson’s bicycle was struck by a 2016 Chevrolet Cruze being driven by Davis.
Anderson was taken to North Kansas City Hospital, where he died a few hours after the crash.
In court documents, Sgt. J. Hall with the highway patrol says upon arriving at the scene he observed a heavily damaged bicycle off the right side of the roadway near an electric pole. The pole itself had a gouge mark on it from the impact of the bicycle, the trooper says.
Within the debris, there was a red plastic piece from a vehicle, according to court documents. The trooper says he was contacted by Riverside police that the vehicle involved was at a roundabout located about half a mile from the crash site. Riverside police remained with the driver of the Cruze until another trooper arrived.
Court documents indicate Davis admitted to consuming alcohol and she told troopers that she had been at Argosy Casino for most of the night and into the morning. Davis allegedly told officers she estimated her first drink had been at around 10 p.m. the night before and her last drink was around 2 a.m.
According to allegations in court documents, Davis blew a blood alcohol concentration of .164%. on a portable breath test. She later consented to a chemical test of her breath, and authorities say at 8:15 a.m. at the Riverside Police Department, Davis provided a breath sample showing her BAC to be .139%.
The legal limit in Missouri is .08%.
