Plenty of depositions were ready while other testimony was presented in living color, but the two lines of argument can be clearly defined in the lawsuit alleging the City of Platte City violated the state’s open meetings law by discussing annexation and annexation boundaries in closed session. 1. The city’s line of defense was basically to admit that annexation and annexation boundaries were discussed in closed session in a Sept. 26 meeting. City officials said they were simply following the directive of legal counsel in doing so. The city’s legal counsel said the closure is allowed because the closed session protected the attorney/client privilege. 2. Bob Shaw, attorney for plaintiff Harold Coons, argued the discussion in closed session violates the Sunshine Law because decisions about annexation, including discussion of annexation boundaries, are policy decisions not allowed as an exception to the state’s open meetings law. Judge Lee Hull is expected to make a ruling in the court case Wednesday.
