Family of man killed crossing I-29 gets $30,000

An Independence family reached a $30,000 settlement in a wrongful death case against a Parkville man after a deadly incident on Interstate 29.

The lawsuit filed with the Platte County Circuit Court reveals Dale Haywood, 39, of Jackson County, attempted to cross Interstate 29 just south of the Barry Road exit at 8:57 p.m. on Nov. 30, 2017. Haywood was struck in the southbound lanes by a 2015 GMC Acadia driven by James Linkey of Parkville.

Haywood suffered blunt force trauma and died from his injuries.

The lawsuit, filed by Dal’Shaonn Haywood, 24, and Minzola Johnson, 56, alleged Linkey acted negligently, carelessly and breached his duty of care to the decedent.

The lawsuit claimed Haywood died “as a direct and proximate result of the negligence and carelessness.”

The lawsuit contends the decedent was conscious prior to his death and suffered in pain.

According to the approved settlement, Dal’ Shannn and Minzola will each receive $9,888.91, while Philip Holloway will be paid $10,222.18 for attorney fees and expenses.
