Weston man faces statutory rape charge

A Weston man has been arrested and charged with statutory rape of a teenager.

Jay Warder, 38, has been charged with a class C felony for allegedly having sex with a teenage girl and a class A misdemeanor for child molestation according to court documents.

According to the statement of probable cause, Warder allegedly began making sexual advances toward the victim in March of 2005 when she was 14 years old and in eighth grade.

The statement says Warder told police that he had known the victim for 13 years prior to the contact. Warder’s initial advances allegedly began with touching of the victim.

The statement says Warder was persistent and the advances turned to kissing.

The statement says the summer of 2006 is when Warder allegedly began having sex with the victim. The statement says the victim reported the first time having sex with Warder occurred on the victim’s front porch.

The statement says the sexual relationship continued until sometime this year when authorities were alerted to the situation. Platte County Prosecutor Eric Zahnd said he cannot comment on when or how the crime was reported.

The statement also says that Warder on at least one occasion video recorded the two having sex.

Police brought in Warder for questioning on Dec. 11. At that time, Warder admitted to touching the victim prior to her seventeenth birthday but said it was consensual.

Warder also said he did not have sex with the victim until she had turned 17 years old. According to authorities, when asked about the video, Warder changed the story and said the victim was 18 years old. Warder then asked to speak with an attorney before answering anymore questions.

Warder is currently being held in the Platte County Detention Center on a $50,000 cash-only bond.

A hearing was set for Tuesday morning to request a reduction in bond. Warder’s attorney Quint Shafer has also filed for a change of venue. An order of protection was filed against Warder in September.
