Arguments heard in children’s tax lawsuit

JUDGE TAKES MATTER UNDER ADVISEMENT

In a court hearing that lasted about an hour, Platte County Circuit Court Judge Megan Benton on Monday morning listened to arguments from all sides in the lawsuit over the children’s fund services tax issue before announcing she is taking the matter under advisement.

The lawsuit, filed on behalf of Platte County residents Greg Plumb and Tara Bennett against the Platte County Commission and the Missouri Department of Revenue, asks the court to impose the children’s services fund quarter cent sales tax that voters approved in November by a 56% to 44% margin.

In December the Platte County Commission voted unanimously not to impose the sales tax, citing their discretion via wording in state law on the topic that uses the word “may” and not “shall.”

It is not known when the judge will announce a ruling.
