Zona Rosa Development and Olshan Properties, the former owner of Zona Rosa, are seeking the court’s approval to move forward with an out-of-court resolution over a claim for damages.
The personal injury case arises from an incident at 8625 NW Prairie View Road in Kansas City, involving a child who was 11 years old at the time.
The minor allegedly sustained an injury to his right hand on June 2, 2018, while visiting Barnes and Noble Booksellers.
According to the Petition for Approval of Minor’s Settlement, Cristal Iman, the minor’s court appointed “Next Friend,” agrees the settlement is “fair and reasonable and should be approved by the court.”
Under the terms of the agreement, the proposed settlement will be kept confidential.
Court documents also point out the proposed settlement is not an admission of liability, but rather a decision by both parties to agree on a settlement and avoid the uncertainties of a trial or lengthy litigation process.
The proposed settlement has been submitted to the court and will be considered for approval by Platte County Circuit Court Judge Thomas Fincham at 9 a.m. on Aug. 7.
