A Platte City woman has brought a personal injury lawsuit against Star Development Corporation and RBE Lawn Care, alleging she slipped and fell in front of Pizza Shoppe due to their negligence.
The five page lawsuit filed in Platte County Circuit Court Wednesday, Aug. 14, accuses Star Development Corporation of Liberty, the owner of the property where the incident allegedly occurred, and RBE Lawn Care of Liberty, the property management company, of failing to keep the grounds reasonably safe for patrons.
The Platte Woods Pizza Shoppe is operated out of the property, which is located at 7687 NW Prairie View Road, Kansas City in Platte County.
The plaintiff, Leigh Ann Moore, 43, slipped and plummeted on ice while visiting the Platte Woods Pizza Shoppe on Dec. 18, 2016, says court documents. As the lawsuit tells it, Moore slipped and fell in an area that “constituted a dangerous condition in that it was covered in ice and/or snow,” the case says.
The lawsuit also contends the defendants should have been aware of the inclement conditions and should have made sure their premises were “reasonably safe” and free of causing harm. The lawsuit accuses the defendants of failing to correct the dangerous condition or failing to make patrons aware of the condition.
Moore is seeking compensation for past medical expenses, lost wages, pain and suffering. The lawsuit claims she will continue to suffer from mental anguish and a loss of enjoyment of life. Attorney Blaine Dickerson with DiPasquale Moore LLC is representing Moore in this case.
Platte County Circuit Court Judge Thomas Fincham has scheduled a hearing on the matter for 9 a.m. on Friday, Nov. 15.
