A Kansas City, Kan., woman is seeking upwards of $50,000 in compensation after slipping and falling at Walmart
Teresa Wallace, 47, filed a personal-injury lawsuit on Friday, June 26 against Walmart located at 8551 N. Boardwalk Avenue in Kansas City, alleging she was injured due to Walmart’s failure to “exercise ordinary care to make its premises reasonably safe for its customers.”
According to the suit, Wallace was shopping in the flower center on June 22, 2019 when she suddenly “slipped on a dangerous condition maintained on the property.”
Wallace allegedly fell to the ground, “injuring her right knee, hip and back,” court documents allege.
Due to the extent of her injuries, Wallace required medical care and knee surgery, the suit says.
Wallace’s injuries caused her to suffer “emotional distress and general pain and suffering.” Wallace, the suit says, “has suffered and will suffer greatly for mental anguish, disruption of nature, and normal activities of daily living,” due to the nature of her injuries.
Wallace’s attorney, Philip Holloway, with Dougherty & Holloway, LLC., points out additional acts of negligence might be brought to light by way of litigation. Holloway will argue his client is entitled under tort law to obtain compensation. Wallace is seeking compensation for lost wages, past and future, and medical bills and for her costs incurred.
The suit claims Walmart should have known that allowing water to collect “in dangerous quantities” on the floor of the flower center would cause a “slipping hazard” on the property. Walmart, the suit says, “failed to warn customers of the dangerous condition on its premises” and “failed to clean up moisture that had spilled on its floor.”
